Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Real-Estate Analyzer ("Real-Estate Analyzer", "we", "us", or "our") governing your access to and use of our website, tools, and related services that provide real estate deal analysis, estimates, and projections (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Informational purposes only; no professional advice
The Service may generate calculations, estimates, forecasts, and other outputs based on information you provide and assumptions selected by you (collectively, "Outputs"). Outputs are provided solely for informational and educational purposes. The Service does not provide (and should not be construed as) investment, financial, legal, tax, accounting, brokerage, or other professional advice.
No guarantee of accuracy: You acknowledge that real estate markets and financing terms are dynamic and that results are inherently uncertain. We do not represent, warrant, or guarantee that any Output is accurate, complete, reliable, current, or suitable for your purposes. You are solely responsible for (a) verifying inputs, assumptions, and Outputs and (b) all decisions and actions you take based on the Service.
Accounts and acceptable use
- You agree not to misuse the Service, including by attempting to interfere with, disrupt, reverse engineer, or gain unauthorized access to the Service.
- You are responsible for all activity that occurs under your account and for maintaining credential security.
- You agree not to use the Service for any unlawful purpose or in violation of any applicable laws.
- You agree not to use automated systems or software to extract data from the Service ("scraping") without our written permission.
- You agree not to transmit any viruses, malware, or other malicious code through the Service.
- You agree not to impersonate any person or entity or misrepresent your affiliation with any person or entity.
User data and inputs
You retain ownership of any data, information, or content you input into the Service ("User Data"). By using the Service, you grant us a limited, non-exclusive license to process User Data solely to provide and improve the Service. We do not claim ownership of your User Data. You are solely responsible for the accuracy and legality of your User Data.
Purchases; billing (one-time payments)
The Service may offer paid features or paid access. Where payment is required, you may purchase access using a one-time payment (i.e., we do not currently offer recurring subscription billing). Payment processing is performed by third-party payment processors. You authorize the applicable processor to charge the amount presented at checkout, including applicable taxes, and you agree to the processor's terms.
Refunds: Payments are processed by Paddle (our payment processor and Merchant of Record). We offer a 14-day refund window from the date of purchase, with no exceptions or conditions. To request a refund within 14 days of your purchase, contact Paddle directly at paddle.net with your order details. You may also reach us at support@realestate-analyzer.com for assistance.
Refunds are subject to Paddle's Checkout Buyer Terms. Paddle may refuse refunds where there is evidence of fraud, refund abuse, or other manipulative behaviour. This refund policy does not affect any statutory rights you may have under applicable law.
Intellectual property
The Service, including its software, design, text, graphics, logos, and other content, is owned by us or our licensors and is protected by applicable intellectual property laws. Except for the limited right to access and use the Service in accordance with these Terms, no rights are granted to you, whether by implication, estoppel, or otherwise.
Disclaimer of warranties
THE SERVICE (INCLUDING ALL OUTPUTS) IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE"BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE OR ANY OUTPUT WILL BE ACCURATE, COMPLETE, RELIABLE, ERROR-FREE, SECURE, OR UNINTERRUPTED.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Real-Estate Analyzer and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any investment or financial decision you make based on information obtained through the Service.
Termination
We may suspend or terminate your access to the Service at any time if we reasonably determine that you have violated these Terms, if your use poses a risk to the Service or others, or as otherwise necessary to protect our rights, users, and operations.
Changes
We may modify these Terms from time to time. The most current version will be posted on this page with an updated effective date. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms. If we make material changes, we may provide additional notice (such as posting a notice on the Service or sending you an email, if you have provided one).
Dispute resolution
Before initiating any legal proceeding, you agree to first contact us at support@realestate-analyzer.com and attempt to resolve the dispute informally for at least thirty (30) days. If we are unable to resolve the dispute informally, you agree that any dispute shall be resolved through binding arbitration administered by a mutually agreed-upon arbitration provider, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
Entire agreement
These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and us regarding the Service and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral.
Assignment and waiver
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be null and void. Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision or our right to enforce it at a later time.
